Terms of Service

These terms are between Buttercloud (buttercloud.com), the maker of Tizmos, and the teacher, school or district that holds a Tizmos account. They cover the website at tizmos.com, the teacher app at app.tizmos.com, the classic Tizmos site, and every Tizmo opened from a link, a QR code or a printed card. By creating an account or using Tizmos you accept these terms. Families and students never hold an account and are not asked to accept anything to open a Tizmo; the account-holding teacher is responsible for what they send.

Your account

You need to be an adult to hold an account. Keep your password to yourself; you are responsible for activity under your account. Provide accurate information and keep your email current — it is how we reach you about your account.

Plans and billing

Making, sending and remixing Tizmos is free for teachers. Pro and Team are paid subscriptions billed monthly or yearly through Stripe at the prices on the pricing page; Schools are priced by agreement. Subscriptions renew automatically until cancelled; cancel any time from Billing and your plan runs to the end of the paid period (no partial refunds unless the law where you live requires them). If a payment fails we will retry and tell you before access changes. Families never pay anything.

Your content

The Tizmos, paths, recordings and printed materials you make are yours. You grant us the licence needed to host them, deliver them to the families you send them to, and display them where you choose to publish them. New Tizmos are listed in the community library by default and appear on your public page; you can set any Tizmo to link-only or draft at any time, and other teachers who remix a listed Tizmo get a credited copy of it. Student reports belong to the classroom relationship: we host them and show them to you, and we use them for nothing else.

Acceptable use

A Tizmo asks a real child to do something in the real world, so: nothing dangerous beyond ordinary supervised activity, and be honest in the mission’s time, place and supervision fields — families rely on them. Don’t use Tizmos to collect information from children beyond what the report-back step provides, don’t impersonate others, don’t upload content you have no right to share, and don’t attempt to break, probe or overload the service. We may remove content or suspend accounts that violate these rules, and where a listed Tizmo is unsafe we may act first and notify you after.

Availability and changes

We work to keep Tizmos available and honest about incidents, but the service is provided “as is” and “as available”, without warranties of any kind to the extent the law allows. We may change or discontinue features; if we ever discontinue something that holds your content, we will give you a reasonable opportunity to export it.

Ending an account

You can stop at any time. If you delete your account, your Tizmos and their reports are deleted per the privacy policy; remixes other teachers made of your listed Tizmos remain theirs. We may terminate accounts that violate these terms.

Liability

To the maximum extent permitted by law, Buttercloud’s total liability arising out of or relating to Tizmos is limited to the amount you paid us in the twelve months before the claim, and neither party is liable for indirect, incidental or consequential damages. Nothing in these terms limits liability that cannot lawfully be limited. Teachers remain responsible for their conduct toward their own students and for compliance with their school’s policies.

Governing law and changes to these terms

These terms are governed by the laws of the jurisdiction in which Buttercloud is registered, without regard to conflict-of-law rules. We may update these terms; the effective date above will change when we do, material changes will be announced to account holders, and continued use after a change constitutes acceptance.
